The email came hours after The Arizona Republic questioned MVD officials about why prosecutors in Arizona's 15 counties were not officially notified of the error.
County prosecutors instead learned about the problem from defense attorneys three weeks ago, setting off a chain reaction of calls between agencies and prompting case reviews across the state. About 1, potential problem cases are already identified in Maricopa and Pinal counties. Those do not include municipal and justice court, which also prosecutes cases involving suspended licenses. It is certainly scary for me as a prosecutor.
Mitchell said a defense attorney shared an MVD letter a client had received about the lack of notification. Mitchell, in turn, reached out to other county attorneys and sent letters to defense attorneys representing drivers whose licenses were suspended, particularly in DUI cases. Doug Ducey's office promised Thursday that MVD has already taken steps to ensure something like this won't happen again. Karamargin, Ducey's spokesman, said as soon as the MVD realized letters weren't sent out, it immediately began notifying license holders of the situation.
The MVD letters are critical to cases involving suspended license violations. The letters are used as evidence a violator was informed by the state that it is illegal for them to drive.
Prosecutors long have operated on the assumption that letters automatically go out to anyone whose license was suspended. Those who are unaware their license was suspended aren't legally culpable. Violations for driving on a suspended license can lead to jail time. Arizona law makes it a felony for a driver convicted of a prior DUI to operate a vehicle on a suspended license.
Drivers with multiple traffic citations also can face license suspension and revocation. If they are stopped, their cars can be towed and impounded. And by the time those drivers are able to prove they weren't notified and were unaware of the suspension, they could face hundreds of dollars in fines, not to mention the loss of their vehicles.
Phoenix lawyer Mark Weingart, who specializes in DUI cases, said the situation was troubling and leaves the state facing claims of wrongful arrest and asset seizure. He said the Maricopa County Attorney's Office alerted him to the issue of the missing notices.
